Procedure for Filing for Bankruptcy

The first thing to do when it comes to filing for bankruptcy is to contact a MN bankruptcy lawyer to help you out. You will need to fill out court papers that will ask you a number of questions pertaining to your current financial situation. This will include:

  • Your income and expenses
  • Your property and possessions
  • The names and address of the creditors

Once the documents have been collected and signed, the next step is to file these documents as well as evidence of your hardship to the federal court. The court will then issue an order to put an end to the creditors and you will be one step closer to absolving your debts. Several days after you file for bankruptcy, the federal court will send you a letter which will contain the date and time of a bankruptcy trustee meeting. You and your bankruptcy attorney will need to attend this meeting.

During your bankruptcy meeting, you can expect the details of your case to be confirmed by the court. Once everything has been confirmed to be true and in order, your bankruptcy claim will be go through and the court will discharge you of your debt. For a Chapter 7 bankruptcy, this can take up to 60 days; for a Chapter 13 bankruptcy, the court and your bankruptcy attorney will determine a suitable payment plan for the next three to five years.

Once your bankruptcy claim has gone through, you are free to start again. The bankruptcy claim will remain on your credit report for seven to ten years but you will still be able to proceed normally through life. You can continue to work, to attend school, to make payments and to save for whatever the future holds.
